01About these terms

These terms are an agreement between you and KD incubator UG (haftungsbeschränkt), Schonensche Str. 13, 10439 Berlin, Germany (“we”, “us”). They cover the Bamboo app for iPhone and Apple Watch, its widgets and Live Activities, and this website (together, “Bamboo”). By using Bamboo, you agree to them.

If you got Bamboo from the App Store, Apple’s Licensed Application End User License Agreement also applies. These terms add to it; they don’t replace it.

Our Privacy Policy explains how we handle your information.

02Who can use Bamboo

Bamboo is for parents, parents-to-be and other caregivers. To create an account or buy a subscription, you need to be old enough to agree to these terms where you live (18 in most countries), or have a parent’s or guardian’s permission.

03Not medical advice

Bamboo helps you record your family’s day and look back on it. It isn’t a medical device, and it doesn’t diagnose, treat or prevent any condition. Growth charts, temperature guidance, feeding and sleep summaries and other insights are general information, not medical advice.

Reminders, alarms and sync do their best, but your phone’s settings, battery, connection and operating system can delay or stop them. Please don’t rely on Bamboo alone for medication timing or anything else that can’t wait.

04Your account and family

You can use Bamboo on your device without an account. To sync or share, you’ll need an account with a verified email address. Keep your password safe, and tell us if you think someone else has used your account.

A family has one admin and one invited partner. When you invite someone, they can see, add, edit and delete all of your family’s records, so only invite someone you trust. The admin can remove a partner at any time, and entries a partner added stay with the family if they leave.

Only add information you’re entitled to share, and only invite people who are happy to receive an invitation.

05Bamboo Pro

Bamboo needs a Bamboo Pro subscription. Partners who join a family through an invitation don’t need their own.

• Subscriptions are sold by Apple through the App Store, monthly or yearly, at the price shown before you buy. Payment is charged to your Apple Account.
• Your subscription renews automatically at the same price unless you cancel at least 24 hours before the end of the current period.
• You can manage or cancel it in your App Store account settings. Deleting the app or your Bamboo account doesn’t cancel it.
• Refunds are handled by Apple under its policies. If we offer a free trial or a discount, we’ll show its terms before you start.
• If the price changes, Apple will tell you in advance and, where required, ask you to agree before you’re charged the new price.

06Your content

Everything you add to Bamboo stays yours. You allow us to store, copy, sync and display it only as far as we need to provide Bamboo to you and your family. That permission ends when you delete the content or your account, apart from anything the law requires us to keep.

07Using Bamboo fairly

Please don’t:

• try to reach accounts or records that aren’t yours,
• interfere with, overload or probe our servers,
• use invitations or our emails to send spam,
• copy, change or reverse-engineer the app, except where the law allows it,
• use Bamboo for anything unlawful.

We may suspend or close an account that seriously or repeatedly breaks these terms. Where we can, we’ll tell you first and give you a chance to put things right.

08Our app and changes

Bamboo, including its design, artwork (yes, the pandas) and software, belongs to us or our licensors. We give you a personal, non-transferable right to use it under these terms.

We keep improving Bamboo, so features can change. If a change significantly affects what you pay for, we’ll tell you in advance. We work hard to keep Bamboo running smoothly, but we can’t promise it will always be available or free of errors.

09Stopping or ending

You can stop using Bamboo at any time and delete your account in Settings → Account. Remember to cancel your subscription with Apple too.

If we ever decide to discontinue Bamboo, we’ll give you reasonable notice.

10Liability

We are fully liable for damage we cause intentionally or through gross negligence, for injury to life, body or health, under the German Product Liability Act, and where we have given a guarantee.

For slight negligence, we are liable only if we breach an obligation that is essential to this agreement and that you can normally rely on, and then only for damage that is foreseeable and typical for this kind of agreement. Otherwise, we are not liable for slight negligence.

Nothing in these terms limits your statutory rights as a consumer.

11Law and disputes

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live.

We are neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board. If something goes wrong, please write to us first. We’d much rather put it right.

12Changes to these terms

We may update these terms, for example when we add features or the law changes. We’ll tell you about important changes in the app or by email before they take effect. If you don’t agree, you can stop using Bamboo and cancel your subscription.
